These are our terms for use of this website (Site). These Terms of Use (terms) apply whenever you access the Site, regardless of how you do so.

Terms of Use of Site

  1. The owner and operator of the Site is Queensland Newspapers Pty Ltd, ABN: 61 009 661 778 of GPO Box 130, Brisbane, QLD 4001 (News), which owns and manages the website for The Courier-Mail Children’s Fund. 
  2. The Site is an information platform for The Courier-Mail Children’s Fund and acts as a gateway to applications for grant funding. The Site may also in future facilitate donations through third-party payment or fundraising service providers.
  3. Each user of the Site (User or you) agrees to be bound by these terms. Your use of and access to the Site indicates your acceptance of and agreement with these terms, as they exist at the time of use.
  4. News will include at the top of these terms the date on which these terms were last updated.
  5. News may amend these terms at any time by posting changed terms on the Site. If you use the Site (other than to review the amended terms) after a change has been published, you will be deemed to have accepted the new terms for the Site.
  6. You agree that the Site requires compatible devices and internet access, may require certain software, may require periodic updates, and may be affected by the performance of these factors. You agree that meeting these requirements, which may change from time to time, is your responsibility.

Intellectual Property and permitted uses

  1. All intellectual property in relation to content on any of the Site (Content) belongs to News.You obtain no interest in that intellectual property. All content made available on any of the Site is protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in the Content.
  2. You may download and view Content or print a copy of material published on any of the Site for personal, non-commercial use provided you do not modify the Content in any way (including any copyright notice). All rights not expressly granted under these terms of use are reserved by News. Unless expressly stated otherwise, you are not permitted to copy, or republish anything you find on the Site without the copyright or trademark owners’ permission.
  3. The logos of the Site are trademarks of News or its related bodies corporate. Other trademarks may be displayed on the Site from time to time. These may belong to third parties. Nothing displayed on the Site should be construed as granting any licence or right of use of any logo, trademark or masthead displayed on the Site, without the express written permission of the relevant owner.
  4. You must not access any part of the Site that you are not authorised to access, or attempt to circumvent any technical, security or access restrictions imposed on your use of or access to the Site.
  5. Except as expressly authorised by News, you must not reproduce, republish, modify, distribute, frame, scrape, text or data mine, or otherwise use any content on the Site for commercial purposes or in any way that is unlawful or inconsistent with these terms. Without limiting the foregoing, you must not use content from the Site for machine learning or artificial intelligence purposes, including training or grounding any model or system, without prior written consent from News.
  6. You must not use the Site for any purpose or in any way which is unlawful.

Donations, applications and use of site

  1. The Site provides general information about The Courier-Mail Children’s Fund and may include functionality that allows users to access or submit applications for grant funding. Publication of information on the Site does not guarantee that any person or organisation will receive funding, support or any other benefit.
  2. News and The Courier-Mail Children’s Fund may determine eligibility criteria, assessment processes and funding decisions in their discretion, subject to any published program criteria.
  3. If the Site enables donations, donations may be processed by third-party payment processors or fundraising platform providers. Your use of those services may also be subject to the terms, conditions and privacy policies of those third parties.
  4. Unless otherwise stated, donations are voluntary and are not refundable except as required by law or where a processing error has occurred.
  5. You must not submit false, misleading, defamatory or infringing material through the Site, including in any application, enquiry or other form. You must not provide personal information about another person, including a child, unless you are authorised to do so.
  6. News handles personal information collected through the Site in accordance with The Courier-Mail Children’s Fund Privacy Policy (and any other privacy policy notified on the Site from time to time). That policy explains how we collect, use, disclose and store personal information, and how you may access or correct your personal information or make a privacy complaint. Liability 

  1. News does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (ACL) or equivalent State or Territory legislation which cannot be excluded, restricted or modified. News otherwise excludes all rights, remedies, guarantees, conditions and warranties in respect of goods or services from your use of the Site whether based in statute, common law or otherwise to the extent permitted by law. To the fullest extent permitted by law and subject to News’ liabilities and obligations under the ACL, the following provisions apply:
  2. Content on the Site is provided as general information only and does not constitute legal, financial, professional or grant eligibility advice.
  3. News does not warrant the accuracy, completeness or currency of the content which you access through the Site. The Content is provided to you “as is” and on an “as available” basis and on the condition that you undertake all responsibility for assessing the accuracy of the Content and rely on it at your own risk. All Content which you access through the Site may be changed at News’ sole discretion and without notice.
  4. News will have no responsibility or liability in relation to any loss or damage that you incur, including damage to your software or hardware, arising from your use of or access to the Site that is not due to News’ negligence, wilful misconduct and/or fraud.
  5. News does not warrant that functions of the Site or which you access through the Site, such as hyperlinks, will be uninterrupted or error free, that defects will be corrected, that there will be no technical problems which prevent or unreasonably delay delivery of the Site or any content which ought to be accessible through the Site, or that News or the server that makes it available, are free of viruses or bugs.
  6. Where permitted under local law, including the ACL, the liability of News for any breach of a term or condition implied by law is limited at News’ discretion, to the supply of any service again or the payment for the cost of having any service supplied again. However, News cannot limit its liability in this manner if you establish that it would not be fair or reasonable for News to do so.

Third Party Content & Links

  1. The Site may include links to third party sites, including application platforms, payment processors, fundraising pages, partner websites or other external services, which are not controlled by News. The appearance of those links on the Site does not indicate any endorsement by News of that third party or its services. You should review the terms and privacy policies of any third party site you access.

General

  1. Content included in the Site is prepared as general information only and may be updated, withdrawn or changed without notice.
  2. We may use automated tools including artificial intelligence tools to assist in creating some content of and operating the Site. 
  3. News respects the intellectual property of others. If you believe that any of the Content as published by News infringes your intellectual property rights, please contact us at [email protected] with details of your claim including a link to the relevant content which we have published and evidence in support of your claim.
  4. These terms shall be governed by and interpreted in accordance with the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland, Australia and the courts of appeal from them.
